We are The Clinic at 158 Ltd, a company registered in Scotland with company number SC285485 and our registered office at 510-512 Dumbarton Road, Glasgow, G11 6SN (“we” or “us”). We are responsible for operating the Site.

We work with various independent healthcare professionals (“Providers”) in respect of the provision of online medical consultations and the issuing of private prescriptions, and secure messaging between them and service users.

Acceptance of Terms

Please read these Terms carefully and make sure that you understand them. If you wish to access the Services via the Site, you will be asked to agree to these Terms. If you do not accept these Terms, you will not be allowed to access the Services via the Site.

We reserve the right to amend these Terms at any time, with such amendments taking effect immediately upon publication. You are encouraged to review these Terms periodically. Continued use of the Site or our Services constitutes acceptance of any changes.

Services Provided

We offer an online communication platform for Providers and service users to connect via the Site through the use of asynchronous telecommunications technologies, video and other communication tools. The Site facilitates communication between Providers and service users to enable the provision of the Services.

Each Provider accesses the Site as a way to communicate with you. Any medical advice which you receive from a Provider via a Service is provided by such Provider, and not by us.

You acknowledge that your reliance on any advice or information provided by a Provider via the Site and a Service is solely at your own risk and, to the fullest extent allowable by law, you assume responsibility for all associated risks.

You will be able to access certain Providers based on the information that you submit to the Site.

You should always seek the advice of your qualified healthcare professionals with any questions or concerns you may have regarding your individual needs and any medical conditions. All information provided by us, or in connection with any communications supported by us, is intended to be for general information purposes only. Your interactions with the Providers via the Site are not intended to replace your relationship with your regular qualified healthcare professionals.

No Medical Care or Advice is Provided by Us

We do not provide medical advice or care.

The content on the Site and the Services, including without limitation, text, copy, audio, video, photographs, illustrations, graphics, and other visuals, is for informational purposes only and does not constitute clinical advice, diagnosis, treatment or recommendations of any kind by us.

Providers are independent healthcare professionals who are registered within the scope of their competencies. The Providers are solely responsible for the quality and appropriateness of the clinical care and advice that they provide to you.

We do not recommend or endorse any specific Providers, tests, doctors, pharmacies, medications, products or procedures.

We do not provide any legal advice or representations in any way regarding any legal issues associated with any advice, information, goods or services offered by a Provider, including but not limited to any compliance obligations or steps necessary to comply with any regulations.

We do not make any representations or warranties about the training or skill of any Provider who provides Services via the Site.

Not for Emergencies

The Services that are accessible via the Site are not suitable for emergency medical treatment. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, YOU SHOULD CONTACT YOUR NATIONAL OR LOCAL EMERGENCY NUMBER IMMEDIATELY.

You should not disregard or delay seeking medical advice based on anything that appears or does not appear on the Site.

You should seek emergency help or follow up care when recommended by a Provider or when otherwise needed.

You should continue to consult with your regular qualified healthcare professional and other healthcare professionals, as recommended by them or a Provider.

Always seek the advice of a doctor or other qualified healthcare professional concerning questions you have regarding a medical condition and before stopping, starting or modifying any treatment.

Risks of Telehealth Services

By using the Services, you acknowledge the potential risks associated with telehealth services, which include but are not limited to the following:

  • information transmitted may not be sufficient (e.g. poor resolution of images) to allow for appropriate medical or healthcare decision making by the Provider;
  • delays in evaluation or treatment could occur due to failures of electronic equipment;
  • a lack of access to your medical records may result in adverse drug interactions or allergic reactions or other judgment errors; and
  • although the electronic systems that we use incorporate network and software security protocols to protect the privacy and security of health information, those protocols could fail causing a breach of privacy of your health information.

User Information

If you submit, upload, post, or transmit any health information, medical history, conditions, problems, symptoms, personal information, consent forms, agreements, requests, comments, ideas, suggestions, information, files, videos, images, or other materials to us or the Site (the “User Information”), you agree not to provide any User Information that:

  • is false, inaccurate, defamatory, abusive, libellous, unlawful, obscene, threatening, harassing, fraudulent, pornographic, harmful, or that could encourage criminal or unethical behaviour;
  • violates or infringes the privacy, copyright, trade mark, trade dress, trade secrets, or intellectual property rights of any person or entity; or
  • contains or transmits a virus or any other harmful component.

You agree not to contact other Site users through unsolicited e-mail, telephone calls, mailings, or any other method of communication.

You represent and warrant to us and the Providers that you have the legal right and authorisation to provide all User Information to us and the Providers for use, as set forth herein and required by us and the relevant Provider.

You agree that information provided by you in connection with the Services and Site shall be governed by our Privacy Policy.

You agree not to:

  • access the Site or use the Services in any unlawful way or for any unlawful purpose;
  • post or transmit: (i) a message under a false name; or (ii) any data, materials, content, or information (including, without limitation, advice, and recommendations) which is: (i) libellous, defamatory, obscene, fraudulent, false, or contrary to the ownership or intellectual property rights of any other person; or (ii) contains or promotes any virus, worm, Trojan horse, time bomb, malware, or other computer programming or code that is designed or intended to damage, destroy, intercept, download, interfere, manipulate, or otherwise interrupt or expropriate the Site or the Services, personal information, software, equipment, servers, or information or facilitate or promote hacking or similar conduct;

  • use robots or scripts with the Site;

By using the Site and consenting to these Terms, you agree not to provide false, inaccurate or misleading information at any time. To do so, would be a breach of these Terms.

You agree to defend, indemnify, and hold harmless us and the Providers from and against all third party claims, damages, and expenses (including, but not limited to, reasonable attorneys’ fees) against or incurred by us arising out of any User Information that you upload to or transmit through the Site or any breach of this clause.

Limitation of Liability Regarding Use of Site

IMPORTANT – YOUR ATTENTION IS DRAWN PARTICULARLY TO THIS CLAUSE AND THE LIMITS OF OUR LIABILITY WITHIN IT.

Except as provided by law, and without limitation:

  • we do not accept any liability for the consequences arising from the application, use, or misuse of any Services made available through the Site, including any injury or damage to any person or property as a matter of negligence, or otherwise; and

We will not be liable, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for:

  • loss or damage caused by you providing inaccurate or incomplete information;
  • loss of your emotional well-being including, but not limited to, any embarrassment caused;
  • loss of income or anticipated profits;
  • loss of opportunity;
  • loss of goodwill or injury to reputation;
  • losses suffered by third parties; or
  • any indirect, consequential, special or exemplary damages arising from the use of the Site or the Service regardless of the form of action.

We will not be liable for any loss or damage (in contract, negligence or otherwise) where:

  • there is no breach of a legal duty of care owed to you by us;
  • the loss or damage is not a reasonably foreseeable result of any such breach; or
  • any loss or damage or increased risk of loss or damage results from a breach by you of these Terms.

Our total liability to you whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with the provision of the Services shall be limited to the amount paid by you in respect of such Service.

We will take all appropriate technical and organisational measures against unauthorised or unlawful processing of your personal data and against accidental loss or destruction of, or damage to, personal data but subject to that and our obligations under law as a data controller, we shall not be responsible for any data loss or unauthorised access by other persons, whether a result of unauthorised access, misaddress, technical failure, technical interference, negligence or otherwise.

We disclaim all warranties, express or implied (to the extent permitted by law) including, but not limited to, implied warranties of satisfactory quality and fitness for a particular purpose. We do not warrant that the Site or any notifications sent by us to you will be free of viruses or other harmful components.

We do not accept any liability or responsibility for the actions or omissions of any third party, including but not limited to the Providers.

We are not liable for loss or damage which arises from your failure to inform your regular qualified healthcare professional about any Services which you access via the Site.

Patient Responsibilities

  • We charge for all Services rendered.
  • You must promptly notify us of any changes to your personal or medical circumstances.
  • It is your responsibility to read all documentation provided.
  • Requests marked as “under review” will be held for a maximum of seven (7) days. After this period, a new request must be submitted.

Privacy Policy

Visits to our Site are anonymous unless you are logged in as a registered user. We do not track personally identifiable browsing activity. All personal and medical information shared with our Site is treated with the highest level of confidentiality and securely stored.

Your Personal Data

All personal data provided as part of your medical profile is encrypted and securely stored within our database infrastructure.

Online Payments

We use Stripe.com for secure online payment processing. Stripe ensures PCI compliance and encrypts all transaction data. We do not store payment information directly. Only a reference token is stored to facilitate repeat transactions using the same card.

Third-Party Interactions

Any interactions with third parties (for example the Providers with whom we work) including payments or services, are strictly between you and the Provider. We accept no liability for any loss or damage arising from such dealings.
